Apple Inc. (AAPL) iPhones Disabled via Anti-Hacking Software

Apple Inc. has issued a software update that creates problems for iPhones modified to work with a cellular carrier other than AT&T Inc. and disables at least some unofficial programs installed on other iPhone handsets.
Apple warned earlier this week that the iPhone update - which adds access to the iTunes Wi-Fi Music Store and fixes some security flaws -- could permanently disable phones running programs that untether phones from its exclusive partner's network.
Several gadget enthusiast Web sites, including Gizmodo and Engadget, as well as online postings from hacker communities reported that, depending on which unlocking program was used, certain modified phones no longer worked after they installed Thursday's software update. In some cases, the phones worked, but only with the original SIM card that ties the phone to AT&T.

Stock Market Wrapup Sept. 28th

Stocks teetered between positive and negative territory for most of the day before finally finishing in the red. On the final trading day of the quarter, the Dow ended down -17 points, while the Nasdaq and S&P fell -0.3%. Oil hit an all-time high intra-day before dropping to close -$1.22 lower at $81.66 a barrel. Gold finished the day solidly higher.
In economic news, the Commerce Department reported that consumer spending rose 0.6% in August, the fastest growth rate in two years, helped by a 0.4% rise in after-tax income adjusted for inflation and lower consumer prices. Consumer prices fell -0.1% for August, while the core CPI, which excludes food and energy costs, rose 0.1%. Wages rose 0.2%. Former Fed chief Alan Greenspan, meanwhile, said the chances that the economy will see a recession are growing, but the odds are still less than 50/50.
On the earnings front, consulting firm Accenture (NYSE: ACN - News) reported a profit of $316.8 million, or 50 cents per share, after the bell last night, beating estimates by 2 cents. Revenue grew 29% to $5.11 billion, easily surpassing the $4.89 billion consensus. The firm also upped its dividend to 42 cents a share. The stock rose 5.9%.
Contract electronics manufacturer Jabil Circuits (NYSE: JBL - News) beat earnings by a penny last night. The company reported net income of $11.7 million, or 6 cents per share, compared with a year-ago loss of -$45.6 million, or -22 cents per share. Excluding one-time items, EPS came in at 29 cents. Revenue climbed to $3.13 billion, a 6% increase. The stock fell -6.8%.
In M&A news, private equity firm Bain Capital Partners has agreed to buy ethernet inventor 3Com Corp. (Nasdaq: COMS - News) for $2.2 billion in cash. As part of the deal, Chinese networking behemoth Huawei Technologies will take a minority stake in 3Com. The acquisition price was a 44% premium to the stock's closing price on Thursday.
Shares of 3Com spin-off Palm (Nasdaq: PALM - News), meanwhile, initially climbed after the company introduced a new $99.99 smartphone last night. The model, called the Centro, is lighter, thinner, and cheaper than its previous offerings. Sprint Nextel (NYSE: S - News) will have exclusivity for the device for 90 days. Palm shares, however, finished the day down -0.8%.

Qualcomm (QCOM) Hires Apple's (AAPL) Former Lawyer

Qualcomm Inc. said Friday that former Apple Inc. executive Donald J. Rosenberg has joined the chipmaker as head lawyer and general counsel.
Rosenberg replaces Lou Lupin, who resigned in August after a series of legal setbacks in the company's patent battles with Nokia Corp. and rival chipmaker Broadcom Corp.
Qualcomm said Rosenberg will be responsible for all legal matters and worldwide legal strategy. He will also hold the titles of executive vice president and corporate secretary.

Jim Cramer's Stop Trading Sept. 27th

Chipotle (CMG) might be expensive, but it's a solid stock that has momentum, Jim Cramer said Thursday on CNBC's "Stop Trading!" segment.
CKE Restaurants (CKR), the owner of Carl's Jr. and Hardee's, is cheaper, but as an investor, you want to buy a company that's expanding and putting up stores, Cramer said.
Chipotle is a "concept" stock that reminds him of Starbucks (SBUX) six to eight years ago.
He also recommended reading a Bank of America research report on Starbucks, in which the coffee-shop owner was downgraded to sell. He said he wished the report had been written earlier, but it was very well researched.

Stock Market Wrapup Sept. 27th

Stocks continued their march higher today, despite more weak housing data. The Nasdaq led the way gaining 11 points, while the Dow and S&P were also finished in the green. Oil traded strongly, rising $2.58 to $82.88 a barrel, while natural gas fell. Gold rose on the day.
On the economic front, the Commerce Department announced that GDP grew at a revised 3.8% annual rate for the quarter ended in June. It was the economy's strongest showing in a little over a year. The National Association for Business Economic is predicting growth of 2.4% for the current quarter ending September. Meanwhile, new home sales fell to the lowest level in seven years for the month of August, dropping -8.3%. The median sales price fell -7.5% to $225,700, the biggest drop in 37 years. Despite the housing woes, fewer workers filed for jobless benefits last week, with claims dropping by -15,000 to 298,000.
In earnings news, retailer Bed Bath & Beyond (Nasdaq: BBBY - News) posted net income of $147 million, or 55 cents a share, compared to $145.5 million, or 51 cents a share, a year earlier. Excluding a one-time tax benefit, EPS came in at 52 cents, in line with analyst estimates. Revenue rose 10% to $1.77 billion, while same-store sales climbed 2.2%. The stock fell -1.1%.
Like most homebuilders, KB Homes (NYSE: KBH - News) wasn't able to turn a profit when it announced earnings this morning, swinging to a loss of -$35.6 million, or -46 cents per share, compared to a profit of $153.2 million, or $1.90 per share, in the year-ago period. The sale of the company's French division helped the bottom line, as its loss from continuing operations came in at -$478.6 million, or -$6.19 per share. Revenue plummeted -32% to $1.54 billion from $2.28 billion a year ago, as unit deliveries dropped -28% and the average selling price fell -7%. The company had two large writedowns on the value of unsold inventory and joint-venture holdings.
Rite Aid (NYSE: RAD - News) shares tumbled -4.2% after the pharmacy reported a wider loss and cut revenue and earnings guidance. For Q2, Rite Aid recorded a loss attributable to common shareholders of -$78.2 million, or -10 cents per share, versus a loss of -$8.2 million, or -2 cents per share, last year. The quarter included a one-time financing commitment charge of $12.9 million. Revenue rose nearly 54% from $4.29 billion to $6.6 billion, but fell just short of the $6.8 billion consensus. The company also cut its full-year guidance to a loss of -$78 million to -$161 million on revenue of $24.5-$25.1 billion. Previously, the company had forecasted a loss of -$47 million to -$129 million on revenue of $25.3-$26 billion.
In other corporate news, Google (Nasdaq: GOOG - News) announced that it is looking to increase its staff by a third over the next several years. Before you get that resume ready, though, note that most of the news jobs will be for engineers located in Europe. If you're willing to relocate across the pond, note that British Airways (OTC: BAIRY - News) today ordered $8.2 billion in new aircraft from Boeing (NYSE: BA - News) and Airbus, making it the airline's largest purchase in more than a decade. The news was considered a mixed bag for Boeing, as previously it was the exclusive large passenger plane provider for British Airways. The planes are expected to be delivered between 2010 and 2014. Boeing shares rose 1.0%.
In M&A news, a group led by JC FLowers said that it would not go through with its $26 billion purchase of Sallie Mae (NYSE: SLM - News). The student lender said it would take legal action, as the group has no basis for breaking the merger agreement.

China Finance Online (JRJC) Stock Continues to Soar on Guidance

China Finance Online (Nasdaq: JRJC - News), a leading Chinese online financial information, data and analytics provider, today updated its revenue guidance for the third quarter ended September 30, 2007.
Due to stronger than expected growth in its core subscription services provided to retail customers, the Company now raises its projected net revenues for third quarter 2007 to be between US$7.1 million and US$7.5 million, compared to the previous guidance of US$6.7 million to US$7.1 million.
In an effort to help investors better understand its financial visibility, starting from third quarter 2007 the Company will initiate guidance on its projected adjusted earnings, a non-GAAP measure that represents net income excluding share-based compensation expenses. The Company has experienced multiple back-to-back quarters of record deferred revenue and cash inflows from its core subscription business, and the Company now expects adjusted earnings in third quarter 2007 to be in the range of US$2.6 million to US$3.0 million.
In fourth quarter 2007 the Company will continue to focus on growing its registered user accounts and fee-based subscribers and furthering enhancements in its telemarketing, technology, and product development capabilities. Backed by record deferred revenue on the balance sheet and continuous improvement in execution capabilities, the Company now expects net revenues and adjusted earnings in the fiscal year of 2008, excluding potential acquisitions, to be US$45 million to US$51 million, and US$19 million to US$23 million, respectively. This guidance reflects the Company's preliminary view based on current plans, estimates and projections. A number of important factors including, but not limited to, fluctuation in the Chinese stock market could cause the actual results to differ materially from those contained in such guidance.

KB Home (KBH) Falls in line with the Poor Housing Market

KB Home (NYSE:KBH - News), one of America's largest homebuilders, today reported financial results for its third quarter ended August 31, 2007. Highlights include:
The Company completed the previously reported sale of its entire 49% equity interest in its French subsidiary, Kaufman & Broad SA. The sale generated total gross proceeds of $807.2 million and an after-tax gain of $438.1 million. The French operations are presented as discontinued operations in the Company's current financial statements and results from prior periods have been reclassified to conform to this presentation.
Revenues totaled $1.54 billion for the quarter ended August 31, 2007, down 32% from $2.28 billion for the third quarter of 2006 due to lower housing revenues. Third quarter housing revenues of $1.53 billion were 33% lower than the year-earlier period, reflecting a 28% decrease in unit deliveries to 5,699 from 7,893 and a 7% decrease in the average selling price to $267,700 from $288,000.
For the three months ended August 31, 2007, the Company reported a loss from continuing operations, net of an income tax benefit, of $478.6 million or $6.19 per diluted share due largely to pretax non-cash charges of $690.1 million related to inventory and joint venture impairments and the abandonment of land option contracts, and $107.9 million related to goodwill impairment. In the third quarter of 2006, the Company's continuing operations generated after-tax income of $129.3 million or $1.60 per diluted share. The French discontinued operations contributed third quarter after-tax income of $443.0 million or $5.73 per diluted share in 2007, including the gain realized on the sale of the operations, compared to $23.9 million or $.30 per diluted share in the third quarter of 2006. Overall, the Company posted a net loss in the 2007 third quarter (including the French discontinued operations) of $35.6 million or $.46 per diluted share, compared to net income of $153.2 million or $1.90 per diluted share in the year-earlier period.
As previously announced, the Company redeemed $650 million of debt during the third quarter, significantly strengthening its financial position. The redemption consisted of all $250 million of the Company's 9 1/2% Senior Subordinated Notes due in 2011 and an unsecured $400 million term loan scheduled to mature on April 11, 2011. The early extinguishment of the notes and loan resulted in a charge of $13.0 million in the third quarter. At August 31, 2007, the Company had $646 million in cash and a debt to total capital ratio of 45% (36% net of cash), a significant improvement from debt to total capital of 54% (53% net of cash) at August 31, 2006.
Backlog at August 31, 2007 totaled 11,880 units, representing potential future housing revenues of $3.07 billion. These levels were down 31% and 38%, respectively, from the 17,198 backlog units and $4.95 billion backlog value at August 31, 2006. The lower backlog unit and value levels in the current quarter reflected negative year-over-year net order comparisons for the past several quarters and lower average selling prices. Company-wide net orders for the third quarter of 2007 totaled 3,907, down 6% from 4,167 in the year-earlier quarter.

CNBC's Fast Money Recap Sept. 26th

Charlie Gasparino joined the "Fast Money" crew to discuss his take on the Bear Stearns (BSC) and rumos that Warren Buffett is part of a group of investors considering a 20% stake in BSC. He believes that Bear Stearns is going to be taken private. Guy Adami suggests that it makes no sense at all for Buffett to acquire Bear. According to Adami, Buffet's expertise is in value plays and Bear isn't a value play. Najarian declares that all brokers are back in play and recommends buying Lehman (LEH). Finerman agrees.
An American Icahn
Carl Icahn: Wants to see BEA Systems (BEAS) sold. Motorola (MOT): Bullish on their risk rewards.
GM On The Road Again
General Motors (GM) ended its two-day strike after making a health care agreement with the United Auto Workers. This changes the tune for General Motors, according to Jeff Macke. He advises buying auto parts suppliers like Lear (LEA), Visteon (VC) and BorgWarner (BWA). Adami suggests looking at Ford (F). Najarian prefers Goodyear Tires (GT).
No Deal
Sallie Mae (SLM) made news on Wednesday as a private-equity group pulled out of a deal to buy it for $25.3 billion. Macke: "stick a fork in it." Najarian disagrees and believes the deals are just being re-shifted down. Finerman isn't surprised the deal fell through. One potential deal that has her interest is Genesco (GCO).

Jim Cramer's Mad Money Stock Recap Sept. 26th

On today's show, Cramer started off by talking about the good news that General Motors (GM) received with the completion of their labor talks that he thinks will move the stock to $45, and the rumors that Warren Buffet is buying a stake in Bear Stearns (BSC) that will move it higher, along with other financial stocks Citigroup (C), AIG (AIG), J.P. Morgan (JPM), and American Express (AXP).

Cramer then started talking about buying inexpensive oil stocks when there is a pullback in oil prices. His stock choice is Gardner Denver (GDI) that will profit from higher oil prices and a weaker dollar. Compared with similar stocks such as Baker Hughes (BHI), National Oilwell Varco (NOV) and Schlumberger (SLB), Gardner Denver's multiple is too low.

Energy Stocks:
Transcanada (TRP): Enterprise Products Partners (EPD) is better.
Valero (VLO): Refining margins are killing the stock.
Transocean (RIG): He thinks the stock will go up when the GlobalSantaFe (GSF) merger is complete. Cramer also mentioned some Canadian Energy Trusts that he likes. The stocks are Canetic Resources (CNE), Pengrowth (PGH), Baytex (BTE), International PBX Ventures (PBX), Penn West Energy (PWE), and Advantage Energy (AAV).

Are You Diversified?:
Cramer recommended Caterpillar (CAT) to his first callers portfolio. He told his second caller to get rid of NYSE Euronext (NYX). Cramer told his third caller to hget rid of Pfizer (PFE).

Cramer spoke to the CEO of Genesis Lease (GLS) which Cramer recommended at $26. He said he was wrong to call the stock a buy then, but you should "back up the truck" now that it's at $22.

Jim Cramer's Stop Trading Sept. 26th

Buy Monsanto (MON), Jim Cramer said Wednesday on CNBC's "Stop Trading!" segment.
Cramer said he'd wait till Friday to buy the stock because it's being marked up as quarter-end approaches by huge institutional money managers. But even at a recent $83, it remains a good long-term play, Cramer said, because of its exposure to the fast-growing energy and agriculture markets.
Cramer also likes Nvidia (NVDA) and SanDisk (SNDK), and he applauded the big labor settlement that will cut health-care costs at GM (GM). But Cramer said he wouldn't buy GM till it came down to $29 from a recent $37, given the company's hefty financing costs and other issues.

General Motors Corp. (GM) Wins Union Dispute

General Motors Corp. won its struggle to unload $51 billion in retiree health costs and improve competitiveness in the latest round of contract talks with the United Auto Workers, but not without a short-lived strike that wrung promises out of GM to keep jobs at U.S. plants.
The two sides tentatively agreed Wednesday to a groundbreaking agreement that allows GM to move its unfunded retiree health care costs into an independent trust administered by the UAW. The union also agreed to lower wages for some workers. In exchange, the UAW won commitments from GM to invest in U.S. plants, bonuses and an agreement to hire thousands of temporary workers which will boost UAW membership, according to a person who was briefed on the contract. The person requested anonymity because the details haven't been publicly released.
Wall Street applauded news of the deal, sending GM shares up more than 9 percent.

Stock Market Wrapup Sept. 26th

Equities rose on the day, with all three major market averages solidly in the green. The Dow closed up 100 points, helped by the end of a strike at General Motors (NYSE: GM - News). The Nasdaq, meanwhile, finished up 16 points, while the S&P tacked on 8 points. Oil initially fell after weekly inventories levels unexpectedly rose, but rallied to close up 77 cents to $80.30 a barrel. The price of gold slipped on the day.

In economic news, the Commerce Department reported that demand for durable goods nose-dived in August, with weakness across most categories. Orders fell -4.9% for the month, worse than the -3.5% drop economists were expecting. It was the biggest decline since January, and comes on the heels of a large 6.1% gain in July. Crude oil inventories, meanwhile, unexpectedly rose last week by 1.8 million barrels to 320.6 million barrels. Analysts were expecting inventories to drop by -2 billion barrels.
Topping the headlines today, the United Auto Workers (UAW) and General Motors agreed to a tentative contract early this morning, ending a 2-day strike. As part of the contract, the two sides confirmed that GM would fund a newly created trust that the UAW will run to administer retiree healthcare benefits. For its part, GM will continue to offer some job guarantees. The UAW hopes to strike similar deals with Ford (NYSE: F - News) and Chrysler. Shares of GM spiked 9.4%.
Shares of defense contractors, including Lockheed Martin (NYSE: LM - News), General Dynamics (NYSE: GD - News), and Raytheon (NYSE: RTN - News), hit or flirted with all-times Wednesday. Defense Secretary Robert Gates was meeting with Congress today to request an additional $45 billion to cover military costs in Iraq and Afghanistan. If approved, Gates' request will raise initial 2008 budget-year war projections by nearly a third to $190 billion.
Shares of Vonage (NYSE: VG - News) fell below a $1 after a jury found that it infringed on six patents held by Sprint Nextel (NYSE: S - News). The VoIP company was ordered to pay Sprint $69.5 million in damages. Vonage said it will seek to try to have the Sprint judgment overturned. Earlier this year, Vonage lost a patent infringement case to Verizon (NYSE: VZ - News) for $58 million plus royalties. Today, a court upheld two of the three patent infringement charges in a separate verdict.
In M&A news, Nasdaq (Nasdaq: NDAQ - News) and Borse Dubai raised their bid for Swedish exchange OMX to $4.9 billion, a 15% increase over their previous offer. The exchanges also made agreements with several large shareholders that combined control nearly 19% of OMX to now secure half of OMX's shares. The moves were made in response to The Qatar Investment Authority increasing its stake in OMX, which could indicate it may try to block the deal. Elsewhere, Bear Stearns (NYSE: BSC - News) shares rose 7.7% on rumors that the investment bank is close to selling a minority stake in itself. Among the potential suitors named include a Chinese bank, HSBC Holdings, and Warren Buffett, among others.
